Welcome to Kinsoul Energy. These Terms of Service ("Terms") govern your access to and use of our website, kinsoulenergy.com (the "Site"),
and the purchase of any products from us. By visiting or shopping with us, you agree to these Terms. Please read them carefully.
If you do not agree with any part of these Terms, please do not use our Site or place an order.
## 1. About Us
Kinsoul Energy is a small, founder-led brand designing handmade bracelets from natural pearls, hand-selected gemstones, and S925 sterling
silver. We are operated by **LuKai Trading LLC**, a limited liability company organized under the laws of the **State of Texas, United
States**.

## 2. Eligibility
By placing an order on our Site, you confirm that:
- You are at least **13 years old**, and if you are under the age of 18 (or the age of legal majority in your jurisdiction), you are using
our Site with the consent and supervision of a parent or legal guardian
- If you are a parent or legal guardian permitting a minor to use our Site, you accept these Terms on the minor's behalf and you are fully
responsible for all of the minor's activity on our Site
- You have the legal capacity to enter into a binding contract (or your parent/guardian does on your behalf)
- You are using our Site in compliance with all applicable laws and these Terms
We reserve the right to refuse service, cancel orders, or restrict access at our sole discretion.
## 3. Our Products
### Handmade and Naturally Unique
Every Kinsoul Energy bracelet is **handmade** using **100% natural materials**. Because we use genuine natural pearls and gemstones:
- **Color, pattern, shape, size, and luster will vary** from piece to piece
- Inclusions, banding, and irregular shapes are **a feature, not a defect** — they reflect the organic character of natural materials
- The piece you receive **may vary slightly from photographs** on our Site
- This natural variation is by design and is **not grounds for a return or refund**
We make every effort to display product colors and details accurately, but the actual appearance may differ depending on your screen
settings.
### Authenticity
Every order includes a **certificate of authenticity** confirming that all gemstones and pearls are 100% natural and that all metal
components are genuine S925 sterling silver. We do not use synthetic, lab-created, or imitation materials.
### Product Availability
All products are subject to availability. We reserve the right to limit quantities, discontinue products, or modify product descriptions
at any time without notice.
## 4. Pricing and Payment
- All prices are listed in **U.S. Dollars (USD)** unless otherwise stated
- Prices do not include shipping, taxes, customs duties, or import fees, which may be added at checkout or charged separately
- We reserve the right to **change prices at any time without prior notice**
- We accept the following payment methods: **Visa, Mastercard, American Express, Discover, Shop Pay, Apple Pay, Google Pay, and PayPal**
By placing an order, you confirm that the payment information you provide is true, accurate, and that you are authorized to use the
payment method.
We reserve the right to **refuse or cancel any order** for reasons including but not limited to: product unavailability, errors in pricing
or product descriptions, suspected fraud, or unauthorized payment.
## 5. Orders
### Order Acceptance
When you place an order, you will receive an order confirmation email. This confirmation does not constitute acceptance of your order — it
is simply an acknowledgment that we have received it. **Your order is accepted only when we ship it to you.**
### Order Processing
- Orders are processed within **1–3 business days**
- You will receive a separate shipping notification with tracking once your order ships

### Order Cancellations
You may request to cancel your order by emailing **hello@kinsoulenergy.com** as soon as possible. We can usually cancel orders that have
not yet entered our packaging process. Once an order has been packed or shipped, it can no longer be cancelled — but you may return it
under our standard 30-day return policy.

## 7. Returns, Refunds, and Exchanges

In summary:
- 30 days from delivery to request a return
- Items must be unworn, undamaged, and in original packaging
- Refunds processed within 72 hours of receiving the return
- Free size exchanges with prepaid label
- Damaged items replaced at no cost — no return required
## 8. ⚠️ No Medical, Health, or Healing Claims
**IMPORTANT — please read carefully.**
Kinsoul Energy bracelets are designed and sold as **wearable jewelry and personal adornment only**. We celebrate the natural beauty of
pearls and gemstones, and we acknowledge the long traditions of meaning that cultures across history have associated with these materials.
However:
- Our products are **not medical devices**
- Our products are **not intended to diagnose, treat, cure, or prevent any disease, illness, or medical condition**
- Our products are **not a substitute for professional medical, psychological, or mental health care**
- Any references on our Site or marketing materials to traditional symbolism, meaning, intention, "grounding," "calm," "energy," or
similar concepts are **for cultural and decorative reference only** and are **not health claims**
- We make **no representations or warranties** that wearing our products will produce any physical, emotional, spiritual, or psychological
effect
**If you are experiencing a health concern of any kind, please consult a qualified medical professional. Do not rely on jewelry as
treatment.**
By purchasing from us, you acknowledge that you understand the above and that you are buying our products as decorative jewelry, not as a
health, wellness, or therapeutic product.
## 9. Care and Use
You are responsible for caring for your bracelet according to the guidelines provided on our Care & Longevity page. Damage caused by:
- Water exposure (swimming, showers, dishwashing)
- Perfume, lotion, hair products, or chemicals
- Prolonged direct sunlight (especially Amethyst and Citrine)
- Soaking or rinsing Lapis Lazuli (Aura pieces)
- Rough handling or improper storage
is **not covered** by our return or replacement policy. Please review our care instructions before wearing.
A subtle patina developing over time is a normal part of natural materials and is not a defect.
## 10. Intellectual Property
All content on our Site — including but not limited to the Kinsoul Energy name and logo, product designs, photographs, illustrations,
copy, blog content, brand stories, packaging design, and the underlying website code — is the **exclusive property of LuKai Trading LLC**
and is protected by United States and international copyright, trademark, and other intellectual property laws.
You may not:
- Copy, reproduce, modify, distribute, or republish any content from our Site without our prior written permission
- Use our brand name, logo, photographs, or product designs for any commercial purpose without written authorization
- Imitate, mimic, or pass off any of our designs as your own
You may share product images and links from our Site on personal social media accounts, provided you credit Kinsoul Energy and do not
modify the original content.
## 11. User Content & Reviews
By submitting reviews, photos, comments, social media tags (@kinsoulenergy), or other content to or about Kinsoul Energy ("User Content"),
you grant us a **non-exclusive, royalty-free, perpetual, worldwide license** to use, reproduce, modify, publish, and display that content
for marketing, promotional, and commercial purposes — including on our Site, in emails, on social media, in advertising, and in product
packaging — without compensation to you.
You represent that:
- You own or have the necessary rights to all User Content you submit
- Your User Content does not infringe on the rights of any third party
- Your User Content is truthful and not misleading
- Your User Content does not contain anything unlawful, defamatory, obscene, or offensive
We reserve the right to remove any User Content at our sole discretion.
## 12. Prohibited Uses
You agree not to use our Site:
- For any unlawful purpose
- To harass, abuse, or harm any person
- To submit false or misleading information
- To attempt to gain unauthorized access to our systems or other users' accounts

Unauthorized resale of Kinsoul Energy products on third-party marketplaces (including but not limited to Amazon, eBay, Etsy, and similar
platforms) is **strictly prohibited** without our prior written approval. We reserve the right to refuse service to any customer or
business reselling our products without authorization.
## 14. Disclaimer of Warranties
Our Site and products are provided **"as is"** and **"as available"** without warranties of any kind, either express or implied, except as
required by applicable consumer protection laws. To the fullest extent permitted by law, Kinsoul Energy and LuKai Trading LLC disclaim
all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and
non-infringement.
We do not warrant that:
- The Site will be uninterrupted, secure, or error-free
- The information on the Site is accurate, complete, or current at all times
- Defects will be corrected
- The Site is free of viruses or harmful components
## 15. Limitation of Liability
To the fullest extent permitted by applicable law, LuKai Trading LLC, Kinsoul Energy, and their respective owners, employees, and
affiliates shall **not be liable** for any indirect, incidental, special, consequential, or punitive damages — including but not limited
to loss of profits, data, use, goodwill, or other intangible losses — arising out of or in connection with:
- Your use of or inability to use our Site or products
- Any conduct or content of any third party on the Site
- Any unauthorized access to or use of our servers
- Any natural variation in our products
Our total liability for any claim arising from your purchase of a Kinsoul Energy product is **limited to the amount you paid for that
product**.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you.
## 16. Indemnification
You agree to indemnify, defend, and hold harmless LuKai Trading LLC, Kinsoul Energy, and their respective owners, employees, and
affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising out of:
- Your violation of these Terms
- Your violation of any rights of a third party
- Your User Content
- Your misuse of our products
## 17. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the **State of Texas, United States**, without regard to its
conflict of law principles.
Any dispute arising out of or relating to these Terms or your purchase from Kinsoul Energy shall be resolved through **good-faith
negotiation first**. If negotiation fails, disputes will be resolved exclusively in the **state or federal courts located in Travis
County, Texas**, and you consent to the personal jurisdiction of those courts.
Nothing in this section limits your statutory consumer rights under applicable law.
## 18. Changes to These Terms
We reserve the right to update or modify these Terms at any time. The most current version will always be posted on this page with the
updated effective date. Continued use of our Site after changes are posted constitutes your acceptance of the revised Terms.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum
extent necessary, and the remaining provisions will remain in full force and effect.
